These Terms of Use and Privacy Policy (collectively called as "Agreement") constitutes a contract between the User/s ("You" / "Your" / "User") and Freedom Enterprises having address at Sr. No.316/1/2, Building No. B, Sukhwani Niketan, Pimpri, Pune - 411017 ("We" /"Us" / "Our"). This Agreement governs your use of this mobile application. You must read and agree to and accept all the terms and conditions contained herein in order to use this mobile application which is available at: https://play.google.com/store/apps/details?id=com.meetroz
We shall have the sole right to change, modify, update, add or remove the terms and conditions contained herein and in the Privacy Policy ("Revised terms and conditions") from time to time and your continued use of this mobile application shall mean that you have accepted and agreed to the revised terms and conditions. It shall be your responsibility to check periodically for revised terms and conditions.
We reserve the right to refuse access to this mobile application to anyone for any reason at any time. We further reserve the right to force forfeiture of any username for any reason. We may, but have no obligation to, remove, edit, block, and/or monitor User Content or any accounts containing content that we determine in our sole discretion as violating this Agreement or public policy.
Purpose of the Mobile Application:
This Mobile Application is a platform for connecting users over for support, mentoring, references and recommendations for their professional, topics. It facilitates users to meet nearby users with whom they wish to interact and connect for Professional networking
Eligibility:
By downloading, accessing and installing this Mobile Application, you represent to us that you are competent to enter into a contract (i.e. You are a major according to applicable law, of sound mind and not disqualified from entering into a contract under the applicable law) and you have read these Terms and Conditions, understand them and agree to be bound by them. In case you are below the age of 18 (eighteen), you may not use this mobile application.
Registration and Creation of Profile:
You will be required to register with us in order to use and avail the features of this mobile application. You represent and warrant that you will provide accurate and correct information and details in your profile. As a part of the creation of your profile on this mobile application, you will have to compulsorily provide us your full name, mobile number, email id, location and interest for networking certain other information to be entered in the profile is optional. It will be notified to you while filling up the profile information whether the information is compulsory or optional.
You agree not to impersonate any other person or create any fake profile or give any fake details/photograph on this mobile application. You shall take reasonable steps to protect the confidentiality of your username and password. You further agree and confirm to notify us as soon as you get the knowledge of any person making unauthorized use of your profile. We shall have the right to remove, delete, block your profile / email id from this mobile application in the event of we becoming aware of any impersonation / fake profile being created by you.
You should update your profile from time to time. Further, in the event that you change or deactivate your mobile number, you will update your account information at the earliest i.e. within 48 hours to ensure that messages are not sent to the person who acquires your old number.
Connecting with other users:
You will be able to connect with other users through this mobile application by sending a request. The user to whom the request is sent may choose to accept or reject the said request. On acceptance of the request by the fellow user, the location and time of meeting will be mutually decided by the users. We do not conduct any background checks of the users to verify their credibility or criminal records. You shall connect with users at your own risk and discretion.
The users will be provided with a list of nearby users along with their profile on this mobile application. The said list is generated from open source and is only a recommendation.
User Behaviour:
The User agrees and acknowledges that:
(a) The User will not use his/her account for any kind of promotion or advertisements. If we find out any such act, your account will be disabled with immediate effect.
(b) The User shall not indulge in any illegal and immoral behavior with other users and also not use his/her account to send inappropriate/pornographic/anti-social messages, videos or pictures to other users.
(c) The User shall not stalk, harass or bully any other user in any way.
(d) The User shall not use foul-language with other users.
(e) Determining the time and location for meet will be the sole responsibility of the concerned users.
User Content:
We may allow you to post / upload / submit / make available any information / content in the form of texts, messages, images, audios, videos or other content (User Content) which may be accessible / viewable to the general public and / or users of this mobile application. When you upload any User Content on this mobile application, you represent and warrant that you have the right, authority, necessary permission to upload the same and that your posting of such User Content does not violate any third party rights including without limitation any one's intellectual property rights, rights of publicity, right of privacy.
You represent and warrant that you shall not upload any User Content which is defamatory, vulgar, malicious, pornographic, hateful, anti-social, violent, harmful, and illegal and / or contains any viruses, corrupt data which may harm or impair the functioning and / or aesthetic appeal of this mobile application or any other third party linked websites / applications.
If any information is shared by you with any third party through the medium of our application, it is solely your responsibility and we will not be in any way liable for the same. Your actions such as request to connect with any person or asking the person to contact you and any other such interactions, will result into a need to share such information. It will be your voluntary action and fully based on your consent. Any communication you have with any third parties outside the purview of this mobile application shall not be of our concern and shall not make us liable in any manner.
You must notify us immediately of any breach of security or unauthorized use of your mobile phone/device. Although we will not be liable for the losses caused by any unauthorized use of your account, you may be liable for losses to us or others due to such unauthorized use.
Liability:
We shall not be liable for any indirect, incidental, consequential damages / losses caused to the User in connection with these Terms of Use and Privacy Policy including but not limited to your use of the mobile application, the content posted by any third party, any damage to your device due to your use of this mobile application, your reliance on any of the profiles, feedback available on the mobile application, any delay in the functioning of this mobile application.
The underlying principle while using this application is to initiate healthy conversations between the users and therefore we expect that all users will conduct themselves in a respectful manner and refrain from using abusive language while connecting with other users.
The user shall be solely responsible for his/her interactions with other users. We do not take any responsibility for the quality of food offered at a particular restaurant. Further, if you decide to meet the fellow user with whom you wish to connect over a meal at any place other than the restaurant listed on this mobile application, you may do so at your sole discretion and we are not responsible for the same.
We will not be responsible for the following:
If any user to whom you send a request to connect, declines your request,
If any user with whom you connect through the mobile application misbehaves with you or abuses you,
if any user with whom you connect through the mobile application backs out at any point of time
De-activation of account:
You have complete right to deactivate your account if you do not wish to use this mobile application. You may deactivate your account by going to the help page or by sending us an email. In the event that you de-activate your account, we will terminate your access to the mobile application and you will not be able to avail the services of this mobile application. Any User Content uploaded by you on this Mobile Application will remain in our database even after de-activation. However, we will not share the same with any third party / entity without your permission.
We will de-activate your account at any point of time and terminate this Agreement if any user reports you to us or informs us of any misconduct on your part.
5. Third Party Links:
This mobile application may contain third party links in the form of advertisements or otherwise. Further, such third party websites will be governed by their respective terms and conditions and privacy policies. We do not have any control over, and assume no responsibility for, the credibility, content, privacy policies, or practices of any third party websites. In addition, we will not and cannot censor or edit the content of any third-party site. By using this mobile application, you expressly acknowledge and agree that we shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website.
6. Intellectual Property:
All the content contained in this mobile application including graphics, images, audios, videos, text, logos, icons, data compilations, and software is the exclusive property of Freedom Enterprises. You agree and confirm not to re-utilize or systematically extract or reproduce any content from this mobile application.
7. Permission to use this mobile application:
Subject to your compliance with this Agreement, we hereby grant you permission to use this mobile application, provided that: (i) your use of this mobile application is solely for your personal use, and you are not permitted to sell or charge others for use or access to this mobile application, (ii) you will not act in any manner inconsistent with these Terms of Service; (iii) you will not duplicate, transfer, give access to, copy or distribute any part of this mobile application in any medium without our prior written authorization; (iv) you will not attempt to reverse engineer, alter or modify any part of the mobile application; (v) you will not attempt to extract the source code of this mobile application; (v) you shall not try to translate the mobile application into other languages, or make derivative versions and (vi) you will otherwise comply with these terms and conditions.
8 Term and Termination:
This Agreement shall come into effect from the time you download this mobile application and shall continue to be effective for the entire period of your use of the same.
9 Indemnification:
You shall indemnify us, our affiliates, subsidiaries, employees, agents, representatives ("Indemnified Party") of any loss caused because of any damages, claims, liabilities, costs which may arise due to any suit, proceeding, demand or action by you or any other user or third party against the Indemnified Party relating inter alia to your failure to comply with the terms of this Agreement or arising due to your misconduct, negligence, defamatory conduct, any fraud by you or your agents.
10 Modifications to the Application:
The application is currently planned on Android. The requirements for the Android system (and for any additional systems we decide to extend the availability of the mobile application to) may change, and you’ll need to download the updates if you want to keep using the mobile application. We do not promise that the updates will be relevant to you and/or will work with the Android version that you have installed on your device. You agree to accept updates to the mobile application when offered to you by us.
We reserve the right at any time and from time to time to interrupt, restrict (without cause and without notice to you), modify or discontinue, temporarily or permanently, the Mobile Application (or any part thereof) with or without any notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Mobile Application.
11. Governing Law and Dispute Resolution:
These Terms of Use and Privacy Policy shall be governed by the applicable law in India. Any dispute as regards this Agreement shall be submitted to the exclusive jurisdiction of courts of Pune.
